This Acceptable Use Policy (“AUP”) discusses expectations we have for you and your obligations when using our Services, which include website hosting, email hosting, website development, digital advertising services, SEO services, and consulting.

TMG Web Co is in the business of facilitating communication between computer networks. Our goal is to allow our users complete access to everything the Internet has to offer, and to help them build their businesses. This AUP facilitates this goal by governing your use of the Services.

Because of the evolving nature of the Internet, our business, and the various ways in which our equipment, technology or network may be abused, abusive activities not set out in this AUP may still be prohibited. Policy Integration

This AUP and our other policies (Privacy Policy, Terms of Service, Support Policy, Refund & Billing Policy, Server Maintenance Policy, and DMCA Policy) are part of your contract with us and govern your use of our network and resources. By using the Services, you agree to abide by all our policies.

Appropriate Use of TMG Web Co Services

Intellectual Property Compliance

Intellectual property rights must be respected. You are required to comply with U.S. laws governing copyrights, trademarks, patents, and other laws governing your use of the Services and intellectual property. Please see our DMCA Policy for the process to notify us regarding potential intellectual property rights infringement.

Network Resource Management

Our network is designed to meet the anticipated needs of our customers and users. You may not place excessive burdens on our CPUs, servers, or other resources, including our customer support services. Consistently reaching capacity limits may result in restrictions on your use of the Services, including suspension, termination, or bandwidth throttling, at our sole discretion.

Prohibited Uses

Email and Communication Restrictions

Spam and Mass Email:

  • Unsolicited commercial email (SPAM) is strictly prohibited
  • Our network is not designed for mailing lists with over 500 recipients
  • You may not send email to more than 500 recipients
  • Email resulting in complaints, network disruption, or unfavorable action by other Internet providers will be considered SPAM
  • All commercial email must comply with the CAN-SPAM Act
  • Email bombing, mail bombers, and spam scripts are prohibited

For mass email needs over 500 recipients, contact our Support Team for alternative service provider recommendations.

Prohibited Content and Activities

The following activities and content are strictly prohibited on our network:

Technical Abuse:

  • Topsites
  • IRC scripts/bots, IRCD (IRC servers)
  • AutoSurf/PTC/PTS/PPC sites
  • IP scanners, brute force programs/scripts/applications
  • File dump/mirror scripts (similar to rapidshare)
  • Anonymous or bulk SMS gateways
  • Cryptocurrency/bitcoin miners
  • Network unfriendly activity that interferes with our network or adversely affects other users
  • Proxies, proxy scripts, or anonymizers of any kind
  • Denial of service attacks

Illegal and Harmful Content:

  • Websites advocating human violence and hate crimes
  • Websites promoting illegal activities or linking to websites that promote illegal activities
  • Content that promotes or advocates human trafficking in any way
  • Sites that promote prostitution or escort services
  • Impersonating another user or falsifying identity in email, Usenet, IRC, or other Internet services
  • Posting personally identifiable information (doxxing) with intent to cause harm
  • Creating, posting, or sending warez, ROMs, CD-keys, cracks, passwords, serial numbers
  • Internet viruses, worms, or Trojan horses
  • Content intended to defeat technical copyright protections
  • Links to prohibited items or instructions for illegal activities

Adult and Restricted Content:

  • Selling or disseminating pornography or erotic material
  • Adult thumbnail galleries/banner exchanges
  • Broadcasting or streaming live sporting events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, etc.) or television

Financial Schemes:

  • Lottery, gambling, or chain letters
  • High-Yield Interest Programs (HYIP), Ponzi or pyramid schemes
  • Prime banks programs, bank debentures/bank debenture trading programs
  • Fraudulent sites (including those listed at aa419.org & escrow-fraud.com)

Controlled Substances:

  • Non-medical drugs or substances used to achieve a high
  • Precursor chemicals for drug production
  • Marijuana and CBD products
  • Pharmaceutical drugs requiring prescriptions
  • Tobacco products (including vaping, e-cigarettes, ENDS products)
  • Medical and herbal supplements

Hosting Resource Limitations

For all hosting services, “unlimited” and “unmetered” are defined by our experience with similarly situated customers. Your use may not exceed that of similar customers and may not include:

  • Streaming content (other than incidental to website operation)
  • Management of very large photo galleries
  • Storage of large amounts of uncompressed or full-size digital images
  • Online file (FTP) serving
  • Distribution of large audio or video content (MP3 files, etc.)
  • Online backups unrelated to your website

We may remove impermissible materials without notice and may delete files using excessive disk space, especially if affecting other customers.

Network Security and Monitoring

IP Address Usage

The IP addresses we assign are the only ones you may use with the Services. Use of other IP addresses may result in service suspension. IP addresses are owned by us and assigned to you while you are a customer. We may change these addresses if necessary, and they will be recycled upon service termination.

Software Licensing

Software provided as part of our Services is generally sublicensed to you and may not be further sublicensed or used for purposes other than those expressly permitted. Software licenses may further restrict your use, and we do not provide support for independently licensed software.

Communications Monitoring

We have the duty and obligation to comply with U.S. law, which may require monitoring your use of the Services. You agree that we are not considered a secure communications medium under the Electronic Communications Privacy Act, and you have no expectation of privacy. We may monitor network use for statistical purposes and network improvement in accordance with our Privacy Policy.

Content and Liability

User Responsibility

You are responsible for any content transmitted or accessed using our network. Transmission, storage, or presentation of information in violation of applicable laws or regulations is prohibited. You may not use our network to facilitate violation of any law, regulation, or this AUP.

Child Protection

TMG Web Co takes a zero-tolerance stance on child pornography, content perceived to be child pornography, or child exploitative content. Any website found to host, link to, or contain such content will be suspended immediately without notice or warning.

Defamation Policy

Pursuant to Section 230(c) of the Communications Decency Act of 1996, TMG Web Co will not remove allegedly defamatory material from hosted websites unless the material has been found defamatory by a Federal or state court of the United States, as evidenced by a court order. As a hosting service provider, we are not a publisher of user content and rely on the legal system to determine whether material is defamatory.

Violation Response and Enforcement

Client Notification

In the event of a policy violation, our Compliance Team will take commercially reasonable steps to notify you via email with relevant details about the alleged violation. Compliance with Federal, State, and Local laws, and court orders will be taken into account when we respond to violations.

Network Stability Protection

If we determine your use impairs the stability of our equipment, technology, or network, we may suspend your use, throttle available bandwidth, or terminate our agreement with you at our sole discretion.

Enforcement Actions

Violations may result in:

  • Warning notifications
  • Content removal
  • Service restrictions or throttling
  • Account suspension
  • Account termination
  • Legal action where appropriate

We encourage you to contact us if you believe someone has violated this AUP. To ensure important matters are addressed promptly, please use our designated communication channels. We require accurate contact information and do not respond to anonymous correspondence.

Export Controls

U.S. export laws apply to your use of our Services. You must confirm your use complies with applicable laws. More information about U.S. export laws: https://www.export.gov/

Law Enforcement Cooperation

We may disclose information, including confidential information, to comply with court orders, subpoenas, warrants, regulations, or governmental requests, or to protect our business or others from harm. We assume no obligation to inform you of such disclosure unless legally required. Responding to civil litigation requests requiring more than ministerial activities incurs a fee of $200 per hour.
